Special Counsel Jack Smith filed a superseding indictment against former President Donald Trump on Tuesday over his actions surrounding the 2020 election. The four charges in the original indictment stay the same, but the wording has changed to conform to the Supreme Court’s ruling that made presidents immune from prosecution for official acts.
NTD discusses this with Jeremy Rosenthal, a trial attorney and founding partner of Rosenthal Kalabus and Therrian, who says Smith has revised the indictment out of an “abundance of caution” to avoid charges being thrown out on immunity grounds.
