Special Counsel Jack Smith’s team is pushing to keep the jury from examining the Presidential Records Act in former President Donald Trump’s classified documents case.
NTD spoke to contributor Mike Leon, who is the director of policy and strategy at the Free and Equal Elections Foundation and the host of the “Can We Please Talk?” news commentary podcast. He said Mr. Smith does not want the recordkeeping law mentioned in jury instructions because he believes it is outside of the jury’s purview, and that prosecutors just want the jury to determine if President Trump’s alleged mishandling rose to the level of a crime under the Espionage Act.
