Breaking Down the Ruling Overturning ATF’s Ban on Ghost Guns

A federal judge has reversed the ban by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) on ghost guns.

NTD speaks to Autumn Patterson, a senior attorney at the Texas Public Policy Foundation, who says the judge ruled the ban was illegal because it went beyond the ATF’s authority. Ms. Patterson said the Department of Justice (DOJ) will likely appeal to the Fifth Circuit.

She says, at that time, some constitutional considerations will come into play, like how “it is the role of Congress, not the executive branch, to write the laws that govern us.” The ATF is part of the Department of Justice, which is part of the executive branch.
